Social Media Sweepstakes Official Rules

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU MUST HAVE OR OPEN AN INSTAGRAM ACCOUNT ON INSTAGRAM.COM.

2. Eligibility

Open to legal residents of the 50 United States and District of Columbia, who are 18 years or the age majority in their State of residence (whichever is older).
You must have or open an account on Instagram.com to participate in the Sweepstakes. Accounts are free and can be opened by visiting Instagram.com.
Employees, officers, and directors of Scentbird, Inc. and 800-Flowers, Inc, and their respective parents, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, any persons involved in the creation, and immediate family members and those living in the same household are not eligible to participate or win a prize.
Void where prohibited by law.

3. Sponsor

The sweepstakes is sponsored and administered by Scentbird,Inc., located at 401 Cottontail LN, Somerset, New Jersey 08873.

4. Agreement to Official Rules

Participation in the sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding.

5. Entry Period

The sweepstakes begins at 6:00PM EST on September 7, 2024 and ends at 11:59PM EST on September 13, 2024 (the “Entry Period”).

Limit one entry per person. Entries in excess of the stated limitation will be void.

7. Selection of Winners

Winners will be selected in a random drawing from all eligible entries received during the Entry Period.
The drawing will be held on or about Monday, September 16, 2024.
The odds of winning depend on the number of eligible entries received.

8. Winner Notification

Winners will be notified via Instagram direct message within 3 days of the drawing.
If a potential winner cannot be contacted, or fails to respond within 5 days, the potential winner forfeits the prize.

10. Winners

1 winner in total will be selected in the random drawing. Limit to one prize package per person.

11. Prizes and Approximate Retail Value (“ARV”)

The winner will receive a Prize package of a) 3x 8ml Fragrances from Scentbird x 1-800-Flowers Collection (ARV$65 USD), b) 3 Scentbird branded atomizer cases (ARV $48 USD), and c) a $150 Savings Pass to 1-800-Flowers.com®(ARV $150 USD)
Total ARV of the Prize Package is $263.00 USD.
No substitution, assignment, or transfer of prizes is permitted, except by Sponsor, who reserves the right to substitute a prize with another of comparable or greater value.

12. Taxes

All federal, state, and local taxes and all other expenses not expressly listed as part of the prize are the sole responsibility of the winner.

13. General Conditions

Scentbird, Inc., reserves the right to cancel, suspend, and/or modify the sweepstakes if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the sweepstakes.
Scentbird, Inc., reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the sweepstakes or to be acting in violation of these Official Rules or any other promotion.

14. Release and Limitations of Liability

By entering, participants agree to release, indemnify, defend and hold harmless ScentBird, Inc., 800-Flowers, Inc. and each of their respective suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parents, subsidiaries and affiliates, and each such party’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind, in whole or in part, directly or indirectly arising out of participation in the Sweepstakes or resulting directly or indirectly from acceptance, possession, receipt, use or misuse of any prize, including, without limitation, personal injury, death and/or property damage, as well as claims based on publicity rights, defamation and/or invasion of privacy.
LIMITATION OF LIABILITY: NEITHER SECNTBIRD, INC., 800-FLOWERS, INC. NOR THEIR RESPECTIVE AGENTS, EMPLOYEES, PARENTS, SUBSIDIARIES, OR AFFILIATED COMPANIES, AS WELL AS, THEIR ADVERTISING AND PROMOTION AGENCIES SHALL HAVE ANY LIABILITY FOR ANY INDIRECT, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF OPPORTUNITY OR GOODWILL. IN ALL EVENTS, THE SOLE MAXIMUM LIABILITY OF SPONSOR AND ITS AFFILIATES SHALL BE LIMITED TO THE ARV OF THE PRIZES SET FORTH HEREIN

15. Disputes

Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts located in Trenton, New Jersey under the laws of the state of New Jersey per Scentbird’s existing website terms & conditions.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights, and obligations, or the rights and obligations of the Sponsor in connection with the sweepstakes, shall be governed by, and construed in accordance with, courts located in Trenton, New Jersey under the laws of the state of New Jersey per Scentbird’s existing website terms & conditions., without giving effect to any choice of law or conflict of law rules.

16. Privacy

17. Winners List

To request the name of the winner, send a self-addressed, stamped envelope to Address: 401 Cottontail Lane Somerset, NJ 08873 by July 26th.
